Auction Terms & Conditions

1. The Services provided by AZEGO Components AG ("AZEGO") are governed by these Terms & Conditions. By participating in this auction, you consent to be bound by these Terms & Conditions as well as by any additional terms that may be imposed by AZEGO or announced at the auction.
2. All potential bidders must register at the auction site or online at www.eXcessportal.com before the auction. AZEGO may, at its sole discretion, deny registration to any person or entity.
3. All products in this auction shall be sold to the highest bidder.
4. Acceptable currency for this auction is EURO. Prices achieved in the auction shall apply ex works. The bidder has to pay any further costs particularly the freight, the packaging and the insurances. Full payment of the purchase price is due after one week after the auction. In the event of default, AZEGO may insist on interest in the statutory amount.
5. The bidder shall pay the price in advance before the products are delivered to him.
6. If any of the products sold to the bidder are defective, AZEGO reserves the right to replace these products or to credit the respective price for the products to the bidder. AZEGO expressly disclaims any warranty or merchantability or fitness for a particular purpose. AZEGO does not grant any further rights in case of a warranty. A liability in excess of this warranty is excluded.
7. AZEGO does not give any guarantees for the products. Photographs are provided solely for the bidder´s convenience and shall not be construed to create any representations or warranties of any kind pertaining to the products.
8. AZEGO will announce any additions to or deletions from the catalogue on the day of the auction. AZEGO assumes no responsibility for and makes not representations or warranties concerning descriptions of products contained in marketing material for the auction. It is the bidder´s obligation to verify such descriptions prior to the auction.
9. AZEGO shall not be liable for any damages of any type or nature (whether in contract, tort or otherwise) sustained or claimed by any bidder or any other person or entity in connection with the auction. This does not apply in cases of mandatory liability according to the law. But in no event shall AZEGO´s liability to any bidder for any act or omission occurring in connection with the auction exceed the amount that such bidder has actually paid to AZEGO as payment for the purchased products.
10. By participating in an auction, each bidder represents, warrants and covenants that it shall not misrepresent its ability to close the transaction pursuant to the Terms & Conditions, it has the capacity to close the transaction, it has actual authority to enter a bid, and to enter into an agreement to purchase the products and any bid it makes on a product constitutes an irrevocable offer to buy the product for the full amount of the bid.
11. These Terms and Conditions, and all questions with respect to the interpretation of these Terms and Conditions, shall be governed and construed in accordance with the laws of Germany, without regard to conflict of laws provisions. The sole forum and venue for any and all disputes arising from and in connection with this contract shall be the courts in Munich.
